By engaging with and using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

ACCEPTANCE & CONTRACT FORMATION

This document becomes a legally binding contract when accepted by:

• Email Acceptance
• Electronic acceptance (email, DocuSign); or Verbal or written communications shall constitute a legally binding agreement.

• Payment of any deposit or invoice

Electronic acceptance or payment constitutes acceptance of all terms, including the glass risk waiver, under South Australian law.


CLIENT ACCEPTANCE DECLARATION

I confirm that:

• I have read and understood the quotation and agreement sent to me.
• I accept the Scope of Works, pricing, and terms
• I acknowledge the risks associated with glass polishing
• I accept this forms a binding contract under South Australian law


IMPORTANT GLASS RISK DISCLOSURE & WAIVER

The Client acknowledges and agrees that:

  1. Glass polishing is an invasive mechanical process which may expose pre-existing weaknesses in the glass.

  2. Despite best practice, glass may crack, fracture, shatter, warp, distort, haze, or fail during or after the polishing process.

  3. Such failure is not caused by negligence, but by the inherent condition, age, manufacture, or prior damage of the glass and Adelaide Glass Polishing reserves the right to full payment if glass has gone through rectification process and the glass is at 80% clarity.


NO-FAULT / NO-CHARGE CLAUSE

If the glass cracks, warps, or becomes unusable during the polishing process:

No charge will be made for the affected glass panel
• The Client acknowledges they would otherwise have been required to replace the glass at their own cost
• The Client suffers no financial loss beyond the pre-existing condition of the glass


LIMITATION OF LIABILITY

To the maximum extent permitted by law, Adelaide Glass Polishing:

• Is not responsible for replacement of glass
• Is not liable for consequential or indirect loss
• Is not responsible for defects revealed during polishing
• Provides no guarantee that polishing will restore glass to “new” condition.

PAYMENT TERMS

  • Payment terms: [e.g. payment on completion / deposit + balance]

  • Work may be suspended for non-payment

  • All prices valid for 30 days from quote date

Variations: Any work outside the Scope of Works:

  • Must be approved in writing

  • May incur additional charges

  • Will be invoiced separately

 

AUSTRALIAN CONSUMER LAW

Nothing in this agreement excludes, restricts, or modifies any consumer guarantees under the Australian Consumer Law, except to the extent permitted by law.

Where permitted, liability is limited to re-supply of the service or rectification, at the Contractor’s discretion.

Governing Law: This agreement is governed by the laws of South Australia, and the parties submit to the exclusive jurisdiction of South Australian courts.

In Australia, the national standard for assessing defects on glass is typically based on a viewing distance of about 3 meters. According to the Australian Standard AS 4667, glass defects are evaluated by standing at that distance under normal lighting conditions.
